ملخص
حاول المشرع العراقي عندما سن قانون الأحوال الخصية العراقي رقم 188 لسنة 1959 المعدل أن يستقي أحكام الأسرة من جميع المدارس الإسلامية بحسب توائمها مع حاجات المجتمع العراقي فلم يتقيد بمذهب بعينه،ومع ذلك فقد اغفل تنظيم الكثير من المسائل ما استوجب ملاحقته بالعديد من التعديلات إلى عام 2003. وبعد عام 2003 وعند كتابة الدستور العراقي ظهر اتجاه قوي يدعو إلى الاحتكام إلى القواعد الدينية في حكم مسائل الأحوال الشخصية وتكلل هذا الاتجاه بنص المادة(41) من الدستور العراقي الدائم لعام 2005 التي أشارت إلى إن العراقيين أحرار في الالتزام بأحوالهم الشخصية،حسب دياناتهم أو مذاهبهم أو معتقداتهم أو اختياراتهم، وينظم ذلك بقانون. لذا عادت الدعوات إلى تعديل قانون الأحوال الشخصية مرة أخرى وبقوة وتكللت بتقديم مشروع لتعديل هذا القانون إلى مجلس النواب العراقي الذي صوت عليه بالموافقة من حيث المبدأ. وقد تعرض موقف مجلس النواب العراقي إلى الكثير من النقد من قبل المنظمات الحقوقية ومنظمات حقوق الإنسان لتسرعه في اتخاذ هذه الخطوة دون الرجوع إلى الجهود الفقهية والحقوقية التي قدمت مجموعة من التوصيات لتعديل القانون والتي لم تلق أذانا صاغية من قبل مشرعينا الذي كانوا في غفلة عنها،ومن هذه الجهود ما طرحه العلامة د.مصطفى الزلمي في هذا الشأن. ولتسليط الضوء على مقترحات د.مصطفى الزلمي لتعديل قانون الأحوال الشخصية العراقي رقم 188 لسنة 1959 أثرنا اختيار البحث فيه.
